OUR STANDARD CONTRACTUAL TERMS OF TRADING

Beau Group and any associated businesses herein after may be referred to as BG.

a. GENERAL

Any contract, instruction, or tort, etc., entered into with BG shall assume to include the following Terms of Trading, unless explicitly stated otherwise.
Beau Group includes all associated subsidiaries and businesses as may be stated at http://beaugroup.com.

b. PAYMENT TERMS
If payment in full upon invoice is not made within ten working days of date of said invoice (may be taken from
postmark or e-mail if an address has been supplied), any or all discounts may be withdrawn, at BGs discretion.
This includes but is not limited to, lump sum fees, discounted rates, and where rates are given based upon a total package of expected services.
As a legally acceptable guide (at time of writing), at full rates, a professional technician or PAs time including our overheads, would be £50+ per hour, a senior technician would be £80+ p/h, a partner or associate £100 - £120 p/h, and a senior partner's time would be £120 - £150 p/h.
This would be plus any out of pocket costs invoiced to us, or paid or incurred by us (this may also include consequential costs).
Furthermore if after persistent failure to settle a particular invoice a third party debt recovery company and or legal action may be instigated within one month of failure to pay the aforesaid invoice.
If legal action is taken court costs may be added / recovered.
Warning; we use some of the best investigation companies and methods available to track long term delinquent payment, across the EU. and USA.

c. GOODS & EQUIPMENT
Any goods delivered to our clients shall remain the sole, or joint where appropriate, property of Beau Group and or its subsidiaries, until payment in full for the service or services have been completed and the necessary final invoice / statement paid.
Beau Group retains the right to recover goods, there shall be no right of use or ownership until final settlement, and access must be maintained by the client, at all times 24/7/365 to that end.
Beau Group accepts no liability for faulty goods supplied to us, but will of course diligently pursue any legal warranty scenarios as appropriate on the client's behalf.

d. SIGNING OFF
A final sign off of Completion of Works, shall not be certified / provided until the final invoice / statement is paid in full.

e. APPLICATIONS & FEES
We reserve the right to not submit or withdraw a current application if, it does not fit our high standards, it is not fully supported by us, and therefore not up to our recommended standards and procedures.
If this is the case, the client may be offered an unsupported (eg. Householder) Application to submit to the relevant Authority, for which no discount shall apply unless previously agreed.
We never financially handle, Local Authority and other fees, ie. Planning / Building Control Application, Engineers fees etc., and such fees are not included in our fee structure. A cheque made payable to the Local Authority, or other body, is usually obtained from the client.

f. LIMIT OF LIABILITIES
A Catch all statement. Any usual terms & conditions and laws, herein not mentioned that may protect Beau Group, in any way shape or form, shall apply to the fullest extent allowed by any relevant law/s etc.
Although any lump-sum fee is generally (all but any exceptions noted), inclusive, excessive and chronic changes may be notified as chargeable. However this will be brought to the clients attention, should the scenario arrise.

g. WARRANTIES
It is our mission to always provide the best possible services at a competitive price wherever possible, and to honour all long term legal obligations to our clients, to that end.
Warranties run from time of handover of completed works, however no warranties shall be honoured until all payments are final and satisfied, and the client shall have no right of use until then.

h. E-MAIL
The supply of an appropriate e-mail address shall constitute an acceptance of e-mail as viable form of correspondence for billing and other essential matters.
It is therefore the clients responsibility to, and essential that, the client maintains said address, notifying any changes or problems immediately by phone and by post.
Whilst taking all reasonable precautions to prevent virus, worms, and any other malicious software, we accept no liability for the same being passed to yourself via e-mail, and or our websites.

i. Copyright
All copyright, IP, & all documents including drawings, shall remain the property of BG at all times, and any allowed right of use is only actively granted while there are no fees outstanding, (disputed or not). BG may recall any document/s, electronic, paper, e-mail, or any other medium, at any time.
Any reproduction in any form, is not permitted without our prior written authority. Copying in black & white must also be agreed.

NB. BG reserves the right to update any of its terms and or conditions etc. at any time and without prior notice.
